Terms Of services

These Terms of Use (this “Agreement”) govern your use of the MyRemoteJob.net services and any related software, code, or documentation (collectively, the “Services”) provided by MyRemoteJob.net, [your company address], [your contact email] (“MyRemoteJob.net”).

This Agreement applies to Customers residing outside the USA and Russia. Customers in the USA or Russia should refer to separate Terms of Use applicable to those regions.

1. Acceptance and Use

THE SERVICES ARE INTENDED FOR BUSINESS PURPOSES ONLY, i.e., for professional or business activity, and not for personal or family use. By clicking on “I Accept MyRemoteJob.net Terms of Use,” you agree that:

  1. This Agreement, including all claims or defenses arising from it, shall be governed by the laws of Switzerland (excluding conflict of law principles).

  2. Any dispute shall be subject to the exclusive jurisdiction of the courts of Zurich, Switzerland.

If you do not agree to all terms, you may not access or use the Services. Acceptance is confirmed automatically by email.

2. Customer Rights and Restrictions

  1. Access and Use: Customers may use Services for internal business purposes only. Unauthorized activities such as copying, selling, reverse engineering, or distributing the Services are prohibited.

  2. Ownership: MyRemoteJob.net retains all rights, title, and interest in the Services. No implied licenses are granted.

  3. Provision: Services will be provided as specified in your account and agreed upon in writing or electronically.

3. Fees and Payments

  1. Payment Terms: All invoices are due within ten (10) days of receipt. Late payment may result in suspension of Services.

  2. Payment Methods: Payments must be made using supported methods in U.S. Dollars. All banking fees are the responsibility of the Customer.

  3. Taxes: Customers are responsible for all applicable taxes, except taxes on MyRemoteJob.net’s net income.

  4. Reports: MyRemoteJob.net will provide reports of Services and costs within 10 business days of the end of the billing period.

  5. Discounts: Discounts or special pricing may be offered at MyRemoteJob.net’s discretion.

4. Customer Obligations

Customers agree to:

  • Use Services per this Agreement and the MyRemoteJob.net User Guide

  • Provide all information reasonably requested to facilitate the Services and compliance

5. Customer Content and Licensing

  1. Customers retain ownership of all content provided.

  2. Customers grant MyRemoteJob.net a worldwide, royalty-free, sublicensable license to:

    • Use content for providing Services

    • Use anonymous content for analytics, product improvement, and internal training

  3. Derived data may be used for marketing, usage analysis, and development purposes.

  4. MyRemoteJob.net may subcontract or use affiliates for Services without additional consent.

6. Indemnification

  1. By Customer: Indemnify MyRemoteJob.net against losses arising from your use of Services, content, or breach of this Agreement.

  2. By MyRemoteJob.net: Indemnify Customer against claims that Services infringe third-party intellectual property, provided Customer cooperates and does not settle without consent.

7. Warranties and Disclaimer

  1. Mutual Warranties: Each party has authority to enter this Agreement.

  2. Customer Warranties: Customer content is lawful, accurate, and compliant with applicable laws.

  3. Disclaimer: Services are provided “as is” with no warranties, express or implied. MyRemoteJob.net is not responsible for unauthorized access, interruptions, viruses, or third-party services.

8. Limitation of Liability

To the maximum extent allowed by law:

  • MyRemoteJob.net shall not be liable for indirect, consequential, or punitive damages.

  • Direct liability is limited to the total fees paid by Customer in the 12 months prior to the claim.

9. Term and Termination

  1. Effective Date: Agreement effective upon acceptance.

  2. Customer Termination: May terminate with 60 days’ notice.

  3. Termination for Cause: Either party may terminate if the other materially breaches the Agreement and fails to cure.

  4. Effect: Unpaid fees remain due; rights and obligations that survive termination remain in effect.

10. Changes to Agreement

  1. MyRemoteJob.net may update terms or rates with 40 days’ notice (or immediately for new Services).

  2. Customers may terminate within 30 days if they do not accept changes.

11. Confidentiality

  1. Confidential information includes any non-public business, technical, or customer information.

  2. Obligations include non-disclosure, restricted use, and reasonable protection.

  3. Exceptions include public information, lawfully known information, independently developed information, or permitted disclosures.

  4. Duration: 5 years after disclosure.

12. Notices

  • By MyRemoteJob.net: Email or posting in Customer Profile is effective.

  • By Customer: Email or site forms; written documents may be required upon request.

13. Miscellaneous

  • Independent contractors; no agency or partnership

  • Severability and non-waiver clauses apply

  • Assignment restrictions and permitted transfers

  • Force majeure releases liability for uncontrollable events

  • Entire agreement, governing law, and dispute resolution apply as stated

14. Definitions
